Welcome to NodeArray.net. These Terms of Service (“Terms,” “ToS”) govern your access and use of the VPS hosting services, website, and technical support provided by NodeArray.net (“the Company”, “we”, “us”, or “our”).
By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Description of Services
NodeArray.net provides Virtual Private Server (VPS) hosting solutions, including compute resources (CPU, RAM), storage (SSD/NVMe), and network connectivity. The specific technical configurations and resources are determined by the tier selected at the time of purchase.
2. Eligibility and Account Security
- Eligibility: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. NodeArray.net is not liable for any loss or damage arising from unauthorized access to your account.
3. Payments, Billing, and Refunds
- Subscription Model: Services are billed on a recurring basis (monthly) as selected during checkout.
- Invoicing: Invoices are generated prior to the service period. Failure to pay by the due date may result in automated service suspension.
- Refund Policy: Due to the nature of resource allocation, refunds are generally not provided for mid-cycle cancellations unless otherwise specified in a specific promotional offer.
- Price Changes: We reserve the right to adjust pricing with at least 30 days’ notice to existing customers.
4. Customer Responsibilities
- Data Backups: While NodeArray.net maintains infrastructure integrity, the customer is solely responsible for backing up their data stored within the VPS. NodeArray.net is not liable for data loss resulting from hardware failure, software issues, or user error.
- Security Management: The customer is responsible for the security of their virtual instances, including operating system updates, firewall configurations, and application-level security.
- Legal Compliance: You agree to use our services in compliance with all applicable local, state, and international laws.
5. Prohibited Activities
Your use of NodeArray.net resources is subject to our Acceptable Use Policy (AUP). Prohibited activities include, but are not limited to:
- Engaging in DDoS attacks or network interference.
- Hosting illegal content, including pirated software or unlicensed copyrighted material.
- Utilizing resources for unauthorized crypto-mining or high-intensity processes that negatively impact other users on the node.
- Sending unsolicited bulk email (SPAM).
6. Service Level Agreement (SLA) & Uptime
We strive for a 99.9% network uptime. Scheduled maintenance will be communicated via email or our status page in advance. NodeArray.net is not responsible for downtime caused by customer-managed software or external network outages beyond our control.
7. Limitation of Liability
To the maximum extent permitted by law, NodeArray.net shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising out of or in connection with the use of our hosting services.
8. Termination and Suspension
We reserve the right to suspend or terminate your access to services immediately and without notice if:
- You violate these Terms or the AUP.
- Your account has an outstanding balance.
- Your VPS instance poses a security threat to our infrastructure.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law provisions.
